• Account Information: Display name, email address, and role (Explorer, Artist, Promoter, or Venue Owner)
• Authentication Data: Email address used for OTP verification and sign-in
• Location Data: Approximate location (with your permission) to show nearby venues and calculate distances
• Usage Data: Check-ins, venue saves, ticket purchases, and in-app activity
• Venue Data (Owners): Venue name, address, contact details, photos, and operating hours
• Financial Data: Ticket purchase amounts (we do not store payment card details)
• Device Data: Device type, OS version, and app version for technical support

2. How We Use Your Information

We use your personal information to:

• Provide, operate, and improve the Vybe application and our services
• Authenticate your identity and secure your account
• Process ticket purchases and send confirmation notifications
• Show relevant venue recommendations based on your location
• Send transactional emails (OTP codes, ticket confirmations, account alerts)
• Calculate and display Vybe Score points and leaderboard rankings
• Notify fans when their favourite artists check in at venues
• Provide venue owners with analytics about their venue performance
• Comply with legal obligations under South African law

3. Legal Basis for Processing (POPIA)

Under POPIA, we process your personal information on the following grounds:

• Contractual necessity: To provide the services you have signed up for
• Legitimate interests: To improve our services, prevent fraud, and ensure platform security
• Consent: For location access and optional marketing communications
• Legal obligation: To comply with applicable South African laws

4. Data Sharing

We do not sell your personal information. We share data only with:

• Firebase (Google LLC): Authentication, database, storage, and analytics — processed under Google's Terms of Service
• SendGrid (Twilio Inc): Transactional email delivery (OTP codes and notifications)
• Google Maps Platform: Location services and mapping features
• Law enforcement: Where required by South African law or court order

5. Data Storage & Security

Your data is stored on Firebase (Google Cloud infrastructure) with servers primarily in the United States. We implement industry-standard security measures including:

• Firestore Security Rules with role-based access control
• Firebase Authentication for all user sessions
• HTTPS encryption for all data in transit
• Firebase Storage rules restricting file access
• Admin 2-Factor Authentication for the Vybe admin portal

6. Data Retention

We retain your personal information for as long as your account is active or as necessary to provide services. You may request deletion of your account and associated data at any time through the app's Settings → Delete Account feature or by emailing support@cloudrifttech.co.za.

7. Your Rights Under POPIA

As a data subject under POPIA, you have the right to:

• Access the personal information we hold about you
• Request correction of inaccurate information
• Request deletion of your personal information
• Object to the processing of your information
• Lodge a complaint with the Information Regulator of South Africa

8. Children's Privacy

Vybe is intended for users aged 18 and older, in line with its nightlife focus. We do not knowingly collect personal information from persons under 18. If we become aware that a minor has created an account, we will delete it promptly.

9. Changes to This Policy

We may update this Privacy Policy periodically. We will notify you of significant changes via email or in-app notification. Continued use of Vybe after changes constitutes acceptance of the updated policy.

1. Acceptance of Terms

By accessing or using Vybe, you confirm that you are at least 18 years of age, have read and understood these Terms, and agree to be bound by them. If you do not agree, do not use the application.

2. Description of Service

Vybe is a real-time nightlife intelligence platform that provides:

• Live crowd data and venue discovery for Explorers
• Artist check-in and fan notification features for Artists
• Campaign management and ticket sales tools for Promoters
• Venue management dashboards for Venue Owners
• In-app ticket purchasing with QR code entry
• A Vybe Score rewards and gamification system

3. User Accounts & Registration

To access most features of Vybe, you must create an account. You agree to:

• Provide accurate, complete, and current information during registration
• Maintain the security of your password and account credentials
• Notify us immediately of any unauthorised use of your account
• Accept responsibility for all activities that occur under your account
• Not create more than one account per person or role

We reserve the right to terminate accounts that violate these terms or engage in fraudulent activity.

4. Venue Owner Terms

Venue Owners who subscribe to the Vybe platform agree to:

• Provide accurate venue information including address, capacity, and operating hours
• Only list venues that they are authorised to manage
• Accurately represent ticket capacity and not oversell events
• Maintain subscription payments as agreed (starting at R599/month)
• Not use the platform to deceive or mislead users about venue details

5. Ticket Purchases

When purchasing tickets through Vybe:

• All ticket sales are subject to venue capacity limits enforced by the platform
• Tickets are non-refundable unless the event is cancelled by the venue owner
• You are responsible for checking event details before purchasing
• Cloudrift Technologies is a platform intermediary and is not responsible for event quality, cancellations, or refunds by venue owners
• Free tickets are issued at no charge and do not guarantee specific seating or admission

6. Prohibited Conduct

You agree not to:

• Use Vybe for any unlawful purpose or in violation of South African law
• Post false, misleading, or fraudulent information about venues or events
• Attempt to circumvent capacity limits or purchase more tickets than permitted
• Reverse engineer, decompile, or attempt to extract the source code of Vybe
• Use automated bots or scripts to interact with the platform
• Harass, threaten, or intimidate other users
• Upload inappropriate, offensive, or illegal content including venue photos
• Impersonate another person or entity

7. Intellectual Property

All content, features, and functionality of Vybe — including but not limited to the name "Vybe", the Cloudrift Technologies brand, app design, code, and graphics — are the exclusive property of Cloudrift Technologies (Pty) Ltd and are protected by South African and international intellectual property laws.

By uploading venue photos or other content to Vybe, you grant Cloudrift Technologies a non-exclusive, royalty-free licence to use, display, and distribute that content for the purpose of operating the Vybe platform.

8. Disclaimers & Limitation of Liability

Vybe provides crowd data and venue information on a best-efforts basis. We do not guarantee the accuracy of real-time crowd levels. Cloudrift Technologies shall not be liable for:

• Loss or damage arising from reliance on crowd data or venue information
• Events cancelled, modified, or misrepresented by venue owners
• Any indirect, incidental, or consequential damages arising from use of the app
• Technical downtime, data loss, or service interruptions

9. Subscription & Payments

Venue Owner subscriptions are billed monthly. We reserve the right to suspend or terminate access if payment is overdue by more than 7 days. Pricing may change with 30 days written notice.

10. Termination

We reserve the right to suspend or terminate your account at our discretion if you breach these Terms. You may terminate your account at any time through Settings → Delete Account. Upon termination, your data will be deleted as described in our Privacy Policy.

11. Governing Law

These Terms are governed by the laws of the Republic of South Africa. Any disputes shall be subject to the jurisdiction of the South African courts.

12. Changes to Terms

We may update these Terms periodically. Continued use of Vybe after changes constitutes acceptance. We will notify you of material changes via email or in-app notification.
